Motion: -'The minor children, K.C., born in 2005, K.C,. born in 2009, K.C., born in 2012, S.C., born in 2014, and S.C., born in 2015 reside in Rolette County, North Dakota, with their mother, Trinity Cree. - K.C., K.C., K.C., S.C., and SC. receive Tempo- rary Assistance for Needy Families from the State of North Dakota through Trinity Cree's grant as of July 31, 2020. r Wayne Charette is not subject to an order for S.C's support atthis time. A search for other children for whom Wayne Charette may owe a duty of support resulted in no other children. Wayne Charette is not employed. Wayne Charette has an occupational qualification as a Welder. See Exhibit 3. There is no order regarding parental responsibility to provide health insurance for SC. It is not known if Trinity Cree has health insurance for K.C. and K.C. and K.C. at no cost. 4. Wayne Charette is unemployed. There is no ev- idence of exceptions to imputation of income. Therefore, income must be imputed to Wayne Charette in the amount of $34,392.00 gross per year. The imputed in- come is based on the highest of the three (3) bases for imputing income and is calculated as follows : Sixty per- cent (60%) of statewide average earnings of $34,392.00 for persons with Wayne Charette’s similar work history and occupational qualifications as a Welder, as shown in the 2020 Employment and Wages by Occupation pub- lished by Job Service North Dakota, times twelve (12) months equals $34,392.00. See Exhibit 4. 5. Total gross annual income is $34,392.00. Net monthly income is $2,421.00. Under the guidelines, $976.00 per month is presumed to be the correct child support amount. The guidelines calcu Iation sheet is Ex- hibit S, 6, 7, 8, and 9. LAW AND ARGUMENT 6. Because Wayne Charette is unemployed, income must be imputed. N.D.A.C. §7S~02-04.1-07(3) states: Except as provided in subsections 4, 5, 6, 7, 8, 9, 10, and 11, gross income based on earning capacity equal to the greatest of subdivisions a through c, less actual gross earnings, must be imputed to an obligor who is unemployed or underemployed. a. A monthly amount equal to one hundred sixty- seven times the hourly federal minimum wage. b. An amount equal to six-tenths of this state‘s av- erage earnings for persons with similar work history and occupational qualifications. c. An amount equal to ninety percent of the obligor‘s greatest average gross monthly earnings, in any twelve consecutive months included in the current calendar year and the two previous calendar years before oom- mencement of the proceeding before the own, for which reliable evidence is provided. In this situation, evidence exists to support (b) as the highest possible level of imputation. There is no ev- idence to consider Subsections 4,5,6, 7, 8, 9, 10. and 11 . Wayne Charette's net imputed monthly income of requires a child support obligation of $976.00 per month, N .D.A.C. §75-02-04.1-10. 7. N.D.C.C. §14~09~08.10. Order. This provision re- quires an order addressing responsibility of the parents to provide health insurance for a minor child when child support is ordered. Each order entered under this code for the support of a minor child or the support of a child after majority under section 14-09—08.2 must include a provision for health insurance coverage for that child. 1. Except as provided in subsection 2, the order must require the obligor to provide satisfactory health in- surance coverage whenever that coverage is available at reasonable cost or becomes available at reasonable cost. 2. If the obligee is an individual with physical cus- tody of the child, the obligee must be required to provide satisfactory health insurance whenever that coverage is avai lable at no or nom- inal cost. CONCLUSION : 8. Based upon the foregoing, It is requested that Judgment be entered as to the issues presented in this Motion. The Court receives the Exhibits in the Motion and after due consideration makes the following: FINDINGS OF FACT 3. The Court has personal jurisdiction of the parties and subject matter jurisdiction in this action. 4. Trinity Cree and Wayne Charette have a fifth child, S.C. born in 2015. 5. Trinity Cree and Wayne Charette have had a fifth child, S.C., born in 2015, for which they‘executed an Ac- knowledgment of Paternity. Child support and health in- surance as to 8.0. has not been addressed. 6. The minor children reside with Trinity Cree in R0- lette County, North Dakota. She is the primary caregiver oi K.C., K.C, K.C., S.C., and SC. for child support pur- poses. 7. Wayne Charette owes a duty of support for these chi ldren and is not subject to an order for support or health insurance. S. K.C., K.C, K.C., 8.0., and SC. receive Tempo- rary Assistance for Needy Families from the State of North Dakota through Trinity Cree’s grant as of January 2006 through July 2008. K.C., K.C., K.C., S.C received Temporary Assistance for Needy Families from the State of North Dakota through Trinity Cree’s grant from April 2009 through 2020. 9. Wayne Charette is unemployed. There is no ev- idence of exceptions to imputation of income. Therefore, income must be imputed to Wayne Charette in the amount of $34,392.00 gross per year. The imputed in- come is based on the highest of the three (3) bases for imputing Income and is calculated as follows: Sixty per- cent (60%) of statewide average earnings of $34,392.00 and occupational qual ifications as a Welder, as shown in the 2020 Employment and Wages by Occupation published by Job Service North Dakota, times twelve (12) months equals $34,392.00. 10. There is no order addressing parental respon- sibility to provide health insurance for K.C. 13. It is not known if Trinity Cree has health insur- ance available at no or nominal cost or if Wayne Charette has health insurance available at reasonable cost. 14. The issues of primary residential responsibility and parenting time are not addressed in this order. From the foregoing Findings of Fact, the Court makes the following: CONCLUSIONS OF LAW 15. The First Amended Judgment dated November 6, 2015, shall be amended as follows: 16. Wayne Charette is the father of K.C, K.C., K.C., S.C., and SC. 17. The issues of custody and visitation are not be- fore the court. 18. a. Wayne Charette must pay ch ild support for K.C.,K.C., K.C., S.C., and SC. in the amount of $976.00 each month. Payments are due on or before the 1st day of each month starting with the month after the Judg- ment is signed. As the support obligation for a child ends, Mr. Charette must pay $895.00 per month for four children; $802.00 per month for three children; $676.00 per month for two children, and then $495.00 per month for one child. Mr. Charette’s child support obligation for a child will continue until the last day of the month in which a particular child reaches age 18, unless that par- ticular child is still in high school and still living with Trin- _. ity Cree at that time. If support is to continue or resume 7- after the month in which the particular ‘ child reaches age 18, Ms. Cree must file the Affi- davit of Custodial Parent with the court. If the affidavit is filed, child support will continue or resume until the last day of the month in which the par- ticular child graduates or reaches age 19, whichever comes first. All child support payments shall be paid to the North Dakota State Disbursement Unit (SDU), PO. Box 7280, Bismarck, ND 58507-7280. D. Wayne Charette may make payments by per- sonal check until a check is returned for nonsufficient funds. After that, payments must be made by cash, money order, or certified check. c. (Examples in- clude getting or losing health insurance for the children, being approved for dis- ability payments, and becoming incarcerated.) 19. Trinity Cree must provide health insurance for K.C., K.C., K.C, S.C., and SC. whenever she can get that insurance for no or nominal cost. If Trinity Cree can- not get insurance for no or nominal cost, Wayne Charette must provide insurance if he can get that in« surance for reasonable cost. By state law, insurance is considered reasonable in cost if Wayne Charette can get itthrough an employer or union or on a group basis. Wetlands, area flood plains, threatened or endangered species habitat, or archeolcgical sites will not be ad- versely impacted. The North Dakota State Historic Preservation Office has concluded that no historic prop- erties will be affected by this project (ND SHPO Ref: 21- 5325). Comments were received and reviewed during the original Finding of No Significant Impact publishing for this project. For a further review of these comments please see Item V, Environmental Impacts of Proposed Project. The review process did not indicate significant en- vironmental impacts would result from the proposed ac- tion. Consequently, a preliminary decision not to prepare an environmental impact statement has been made. This action is taken on the basis of a careful review of the engineering report, environmental information docu- ment, and other supporting data which are on file in the Municipal Facilities Division of the North Dakota De- partment of Environmental Quality.
